(Or were you present), have you witnessed that Allah has prohibited this? When they could not answer that, they started fabricating by saying: "Allah ordained such and such!" so, Allah says, (So, who does greater wrong than the one who fabricates lies against Allah in order to mislead people without knowledge). It is considered a wrongdoing for one to give a fatwa on a religious matter unless he believes -to a great degree- that its accurate and pleasing to Allah. That is because if he is among people who are competent for independent reasoning (Ijtihad), then he would rely on a valid proof; or if he is a follower of a competent scholar, then he must be sure that he conveys the right fatwa of his scholar. Ibn Ashur: 8/135.
