ﮜ ﮝ ﮞ ﮟ ﮠ ﮡ ﮢ ﮣ ﮤ
ﮥ ﮦ ﮧ ﮨ ﮩ ﮪ
ﮫ ﮬ ﮭ ﮮ ﮯ ﮰ
ﮱ ﯓ ﯔ ﯕ ﯖ ﯗ ﯘ ﯙ ﯚ ٢٣ ٢٣
وَإِنۡ أَرَدتُّمُ ٱسۡتِبۡدَالَ زَوۡجٖ مَّكَانَ زَوۡجٖ وَءَاتَيۡتُمۡ إِحۡدَىٰهُنَّ قِنطَارٗا
It is better and more appropriate to follow the example of the Prophet (r) in giving a moderate dowry. Al-Saadi: 173.
Question: What is the best approach when deciding the amount for dowry?
وَإِنۡ أَرَدتُّمُ ٱسۡتِبۡدَالَ زَوۡجٖ مَّكَانَ زَوۡجٖ وَءَاتَيۡتُمۡ إِحۡدَىٰهُنَّ قِنطَارٗا فَلَا تَأۡخُذُواْ مِنۡهُ شَيۡـًٔاۚ أَتَأۡخُذُونَهُۥ بُهۡتَٰنٗا وَإِثۡمٗا مُّبِينٗا ٢٠
Taking back the dowry from the wife is called (injustice) because it was their custom in the past, when one hated his wife and wanted to divorce her, he would accuse her of bad partnership and other unfounded charges so that she becomes fearful for her reputation and agrees to pay him money to divorce her. Ibn Ashur: 4/289.
Question: Why is taking the dowry that the husband paid to his wife called (injustice) in this verse?
وَكَيۡفَ تَأۡخُذُونَهُۥ وَقَدۡ أَفۡضَىٰ بَعۡضُكُمۡ إِلَىٰ بَعۡضٖ وَأَخَذۡنَ مِنكُم مِّيثَٰقًا غَلِيظٗا ٢١
The solemn covenant that is taken by wives from their husbands is keeping in all kindness, or releasing with good treatment. Al-Tabari: 8/127.
Question: What is the solemn covenant that wives took from their husbands?
وَكَيۡفَ تَأۡخُذُونَهُۥ وَقَدۡ أَفۡضَىٰ بَعۡضُكُمۡ إِلَىٰ بَعۡضٖ وَأَخَذۡنَ مِنكُم مِّيثَٰقًا غَلِيظٗا ٢١
Since the previous verse dealt with the ruling of divorce caused by the wife, and therefore the husband is entitled to take money back from her, Allah follows that by mentioning the divorce caused by the husband, and that if the husband wants a divorce that is not caused by disobedience or bad treatment by the wife, then he does not have the right to ask her for money. Al-Qurtubi: 6/170.
Question: When is it prohibited for the husband to ask for money to divorce his wife?
وَلَا تَنكِحُواْ مَا نَكَحَ ءَابَآؤُكُم مِّنَ ٱلنِّسَآءِ إِلَّا مَا قَدۡ سَلَفَۚ إِنَّهُۥ كَانَ فَٰحِشَةٗ وَمَقۡتٗا وَسَآءَ سَبِيلًا ٢٢
Immorality includes immoral contracts as well as immoral acts. Ibn Taimyah: 2/222.

حُرِّمَتۡ عَلَيۡكُمۡ أُمَّهَٰتُكُمۡ وَبَنَاتُكُمۡ وَأَخَوَٰتُكُمۡ وَعَمَّٰتُكُمۡ وَخَٰلَٰتُكُمۡ
This list of prohibited women for a person to marry is attributed to a noble principle of preserving the honor of these women, which is one of the earliest manifestations of human progress. Ibn Ashur: 4/289.
Question: Why are these women prohibited for a person to marry?
وَأَن تَجۡمَعُواْ بَيۡنَ ٱلۡأُخۡتَيۡنِ إِلَّا مَا قَدۡ سَلَفَۗ
Allah mentions the case of one who is married to two sisters simultaneously and forbade it. That is because this will be a cause of severing ties of kinships. Al-Saadi: 174.
